How does it work?
The Second Chance Law establishes a clear and structured legal procedure that allows debtors to cancel their debts and start over. At Reestruktura, we guide our clients through every step of this process, ensuring a smooth and effective application. The process is divided into several stages:
Initial evaluation:
We perform a thorough analysis of the client’s financial situation to determine their eligibility and the viability of benefiting from the Second Chance Law.
Extrajudicial payment agreement:
We attempt to negotiate an agreement with creditors that allows the debt to be restructured in a way that is manageable for the debtor. This agreement is presented before a notary and, if accepted by creditors, avoids the need for court proceedings.
Bankruptcy procedure:
If an out-of-court agreement is not reached, bankruptcy proceedings are initiated before the court. During this process, the debtor’s debts and assets are evaluated, and a payment plan is established.
Exemption of unsatisfied liabilities:
At the conclusion of the bankruptcy procedure, the debtor can request the exoneration of unpaid debts, thus freeing himself from his financial obligations.
